IMPLEMENTATION OF GOVERNMENT REGULATION (PP) NUMBER 9 OF 1975 CONCERNING SUB-DISTRICT DISPENSATION TO ACCELERATE MARRIAGE FROM THE PERSPECTIVE OF MAQASHID SHARIA

The purpose of this research is to find out the causes of prospective brides applying for dispensation, what are the supporting and inhibiting factors and how is the maqashid sharia analysis of granting dispensation to the Sub-district Head on behalf of the Regent to accelerate marriage in Tembilahan District. This research is field research, namely researchers looking for data directly at the scene, namely in Tembilahan District as primary data and researchers take books, journals, documents as secondary data. The data collection techniques in this study are observation, interviews and documentation and literature study. While the data analysis technique used is descriptive qualitative. The results of the study show that the reasons that commonly become the basis for dispensation applications include; the bride and groom have important business so they have to leave Indonesia, are late in notifying their marriage intention at the Office of Religious Affairs (KUA) either due to negligence or ignorance about marriage dispensation, have notified their marriage intention more than 10 working days before the marriage contract but there are deficiencies in the marriage requirements and do not get permission for a long time from the place of work. Supporting factors for the sub-district dispensation are good communication and responsive resources and inhibiting factors are sometimes poor communication, inadequate resources and no standard procedure from the Government for applying for sub-district dispensation to accelerate marriage. The implementation of this dispensation is dharuri in nature which protects five things, namely: religion, offspring, soul, property and honor.
